1. General Conditions

• This website is operated by Justyna Rozacka.
• All sales, artwork descriptions, and services provided through this website are governed by these Terms and Conditions.
• We reserve the right to modify these terms at any time. Changes will take effect immediately upon posting to the website.

2. Artwork & Orders

• Product Representations: Every effort is made to display the colors, textures, and details of original artwork accurately. However, actual colors may vary slightly depending on your device’s screen settings.
• Availability: Original artworks are unique, one-of-a-kind items. Orders are subject to availability. In the rare event an item becomes unavailable after purchase, you will be notified immediately and issued a full refund.
• Pricing: All prices are listed in GBP £ and are subject to change without notice. Prices do not include potential import duties or local taxes for international orders.

3. Shipping & Delivery

• Processing Time: Orders for original artwork are carefully packed and dispatched within 3–5 business days of payment confirmation.
• Shipping Destinations: Ships domestically within UK.
• Packaging: Artwork is securely packed using protective materials to prevent damage during transit.
• Delivery & Tracking: Orders are shipped via tracked carrier services. Delivery estimates are provided at checkout, but delays caused by customs processing or postal logistics are beyond our control.
• Customs, Taxes, and Import Fees: International buyers are responsible for any import duties, taxes, or customs clearance fees levied by their destination country.

4. Returns, Cancellations, and Refunds

• Original Artwork Sales: Due to the fragile and unique nature of original art, sales are final. However, if you are unsatisfied with your order, please contact me at contact@justynarozacka.com within 7 days of delivery to discuss potential solutions.
• Damaged Items: If your artwork arrives damaged in transit:
  1. Take photos of the damaged packaging and artwork immediately upon receipt.
  2. Contact us within 48 hours of delivery with details and photos.
  3. Keep all original packaging materials for claim verification.
• Return Shipping Costs: If a return is agreed upon, the buyer is responsible for return shipping costs unless the return is due to damage incurred prior to delivery. Items must be returned in their original packaging and condition.

5. Copyright & Intellectual Property

• Ownership of Artwork: Purchasing an original painting, print, or custom artwork transfers physical ownership of the item to the buyer, but does not transfer copyright or reproduction rights.
• Artist Rights: Justyna Rozacka retains full, exclusive copyright to all creations, images, text, and designs on this website.
• Restrictions:
  • You may not reproduce, copy, resell, redistribute, or scan any artwork for commercial or personal gain without prior written permission.
  • You may not use images of the artwork for commercial products, promotional materials, or digital distribution.
• Exhibition & Portfolio: The artist retains the right to display images of all sold artworks in portfolios, promotional materials, online channels, and print books.

6. Commissioned Artwork

• Custom artwork requests require a signed commission agreement and a non-refundable deposit of 50% before work begins.
• Final payment must be cleared prior to dispatch.
• Commissioned artworks are custom creations and are non-refundable once completed.

7. Limitation of Liability

• Justyna Rozacka is not liable for any indirect, incidental, or consequential damages resulting from the use of this website, delayed shipments, or handling of artwork after delivery.

8. Governing Law

• These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the local courts.
